
ARTICLE XVII
ADDITIONAL COVENANTS

Section 1. General Purposes. These covenants are made for the purpose of creating and keeping the Ranch, insofar as possible, safe, desirable, attractive, beneficial and suitable in appearances and guarding against fires and unnecessary interference with the natural beauty of the Ranch, all for the mutual benefit and protection of the Shareholders of the Corporation.
Section 2. Temporary Buildings. Buildings of a temporary nature are not allowed; but trailers, campers and overnight camping shall be permitted, subject to such rules and regulations as the Board may establish. Please be aware that trailers, recreational vehicles and campers not licensed for the current year may be cited by Summit County. The Shareholder shall provide for waste disposal by using a septic tank approved by Summit County or having the waste pumped out at a state approved waste disposal site and removed from any such recreational vehicle, trailer or camper. Under no circumstances shall any waste be deposited on the Ranch.
Section 3. Animals. No animals, livestock or poultry of any kind except horses shall be raised, bred or kept on the Ranch, except that dogs, cats or other household pets may be kept provided that they are not kept, bred or maintained for any commercial purposes. Exceptions, if any, must be made with the written consent of the Board. In addition, no pet shall be allowed to become a nuisance to other Shareholders.
Section 4. Water and Sewage. No individual water supply or sewage disposal system shall be permitted on the Ranch unless such system is located, constructed and equipped in accordance with the requirements, standards and recommendations of the federal, state or local public authorities and with the prior written permission of the Board. No outdoor (pit) toilets, outdoor clothes poles or clothes lines and no storage of vehicles or material of any kind shall be permitted without written consent of the Board.
Section 5. Fires. No open fires shall be permitted on any part of the Ranch. All chimneys and fireplaces shall be covered with spark screens. Fire pits meeting forest service guide lines shall be permitted, subject to rules and regulations as established by the Board. The Board reserves the right to forbid fires due to weather or forest conditions.
Section 6. Tree Cutting. Cutting of live trees is prohibited except by prior written permission of the Board. The cutting of dead trees for winter wood supply is permitted. Shareholders cutting dead wood must sign in and report the number of hours worked and any and all equipment or vehicles used to the Member of the Board with stewardship over the forest for credit by the Forest Service. However, trees, shrubs, grass, and undergrowth of any nature within 10 yards of the outside perimeter of a cabin or other outbuilding must be trimmed and cut back for fire safety purposes. A firebreak shall be cleared for a minimum 30 feet surrounding each cabin, shed, etc. A firebreak shall be accomplished by thinning the natural vegetation and removing dead plant material and other flammable fuels. The Corporation may, from time to time, need to cut trees, shrubs, or other growth in the area surrounding a cabin for fire control, access, utility work or other purposes.
Section 7. Residential Use. No building or Cabin or Land shall be used for any purpose other than residential or recreational use; any and all commercial uses are strictly prohibited
Section 8. Garbage. All garbage, including trash, tin cans, paper, etc., must be kept in covered containers. Shareholders shall be responsible for removal of garbage or trash from their own cabins and surrounding areas.
Section 9. Signs. No signs, billboards, advertising or any nuisance of any nature shall be erected, placed, displayed or maintained on any part of the Ranch without the prior written permission of the Board. The Board may place informative signs on bulletin boards, cabin location and directional and traffic control signs, and outbuildings as needed.Section 10. Antennas. Standard television, radio and satellite antennas less than twelve (12') feet above the roof line of the Cabin may be used by Shareholders if placed in an inconspicuous location.
Section 11. Roads. All roads and driveways within the Ranch are to remain private and under the control and maintenance of the Board, subject to easement rights of the Shareholders for reasonable ingress and egress to cabins.
Section 12. Gates. The Board may from time to time erect and maintain gates across private roads to control ingress. All Shareholders in good standing may purchase keys, cards, or access codes for a nominal cost. The Board may also grant access to others as needed for construction, maintenance, sales, law enforcement, etc.
Section 13. Grazing Rights and Fencing. No grazing of sheep, cattle or livestock except horses shall be permitted on the Ranch. The Board shall establish rules and regulations governing the keeping of horses on the Ranch, including a reasonable fee to be charged to the Shareholder for the pasturing of horses on the Ranch. The Board may, from time to time, grant permission to allow passage of livestock through the Ranch en route to public or private lands. No fence, wall or similar type barrier of any kind shall be constructed, erected or maintained on the Ranch except as may be approved by the Board.
Section 14. Nuisance and Firearms. No noxious or offensive activity shall be carried on within the Ranch nor shall anything be done or permitted which shall constitute a public nuisance therein. No hunting shall be permitted nor shall any firearms be discharged within the Ranch except as may be established by the Board.
Section 15. Clean Up of Property. Each Shareholder shall have the right and responsibility to clean, repair or remove garbage, trash, material or property, anywhere within the Ranch. Any Shareholder may be charged for any and all necessary expenses incurred in cleaning, repairing or removing said material, garbage or trash in the immediate vicinity of his/her cabin.
Section 16. Water. Water provided by the Corporation is for culinary purposes only. Any use for landscaping shall be with written permission of the Board.
